Surfari internet Provider Services Customer Agreement for Business Services Effective February 2, 1998 This is a contract. Read it carefully. Surfari Internet Provider Services requires that everyone who uses it's services understand and agree to all it's terms prior to submitting their registration. Thank You. This customer agreement applies to all accounts other than Individual Accounts, referred to herein as Business Account(s). The "Surfari Internet Provider Services Customer Agreement for Individual Internet Services" applies in total with the following exceptions: 6. Account Usage. When you sign this agreement and pay the appropriate charge, you are entitled to an account. A Business Account entitles a representative of the Business to logon only on one dial-up modem or TCP/IP session at a time. You agree not t o resell, sublet, share, or otherwise make available your account(s) to other than official representatives of your business. You may advertise products or services for the business identified on the submitted sign-up form. You may not advertise for oth er businesses not shown on the submitted sign-up form without prior, written approval of Surfari.Net. 7. Modem Usage. Business Accounts are for support of non-transferable business use. You agree not to use shared resources to such a degree that such use adversely impacts the availability of the network to other Surfari Net customers. You acknowledge that Business Accounts are not intended for those situations where a modem connection is maintained semi-permanently. Business Account owners agree that at no time will you maintain more than one simultaneous modem connection. You agree that Surfari.Net may, in its sole discretion, automatically disconnect sessions with no activity for a prolonged period of time. You also agree that you will not use automated programs to defeat idle time-out. 8. Disk Usage. You agree that storage of user data will be done within the business' assigned home directory, or as assigned by Surfari.Net's staff. You agree not to use other disk space, except for Surfari.Net's system programs making temporary use of the system's public file system areas. Surfari.Net agrees to provide account users 10 megabytes of disk space. Those requiring additional disk space may contact Surfari.Net for additional details. Additional agreements are as follows: 16. Advertising Accounts. The Billing Agreement, as outlined in section 11 of the Surfari Internet Provider Services Customer Agreement for Individual Internet Services, applies in total. Due to the unique nature of Advertising Accounts, not having dia l-in capability, the Agreements relating to Modem Usage (section 7), Disk Usage (section 8), E-Mail Usage (section 9), and Usenet Usage (section 10) do not apply. Advertisement content shall be mutually agreed upon by the customer and Surfari.Net staff. Surfari.Net shall not be responsible nor held accountable for any actions taken towards or in respect to the Advertising Account owner as a result of information contained within an advertisement on Surfari.Net equipment. 17. Server-side Programming. Business Accounts may operate server-side programs for the purposes of supporting their business account. Such programs will be mutually agreed upon between the Business Account owner and Surfari.Net. If such programs are found to be operating at a level that (in the opinion of Surfari.Net staff) degrade the performance of Surfari.Net equipment, said programs may be disabled at the discretion of Surfari.Net staff without warning. Access to server-side programming, such a s compilers, will be provided on a case-by-case basis and only with prior approval. 18. Domain Registration. Business Accounts may use a registered domain on Surfari.Net. The Business Account owner may obtain said domain name in accordance with established Internic agreements or have Surfari.Net obtain a domain name as their agent. N o one shall assign a domain name to Surfari.Net equipment without approval of the Surfari.Net staff. If registered by Surfari.Net, the billing of Domain Registration fees shall initially include the first 2 years payment, then shall be on a 1 year cycle thereafter. If the Business Account owner obtains the domain name, the billing of Domain Registration fees shall be on a 1 year cycle. If the Business Account owner obtained the domain name, the Business Account owner is responsible for all fees and pay ments to the Internic. At such time the domain name is no longer registered or valid with Internic, it will not be utilized on Surfari.Net equipment. 19. Availability of Service. Surfari.Net will not be held accountable for any actions taken by Business Account owners or customers referencing the level of service provided by Surfari.Net. Due to the complicated nature of interconnectivity, availabili ty of Surfari.Net service to any portion of the internet may be impacted by reasons beyond the control of Surfari.Net.
